Terms

Terms of use

Last updated 26 October 2026

These terms apply when you download or use the Waxwing app for Mac, buy a Waxwing plan, or use waxwing.email. Please read them, especially the parts about payment, refunds and AI. How we handle personal data is described in the Privacy Policy.

In short
  • Waxwing runs on your Mac. Your mail goes between your Mac and your mail provider, and we never receive it.
  • Waxwing is in beta and free. A free Waxwing account turns on every feature; without one, Waxwing is still a complete mail app. Paid plans aren't on sale yet.
  • If you change your mind, ask within 14 days of paying and we'll refund you in full.
  • AI can be wrong. Check what it writes, finds or translates before you rely on it.
  • If a plan ends, Waxwing goes back to the free version. You never lose access to your mail.

This summary is here to help. The full terms below are what apply.

1. Who we are

Waxwing is made and sold by Ihar Litvinovich, a sole trader (jednoosobowa działalność gospodarcza) registered in Poland:

Ihar Litvinovich
Warszawa, Poland
NIP (tax ID): 7011083588 · REGON: 521736373
Email: support@waxwing.email

“We”, “us” and “our” in these terms mean Ihar Litvinovich. “You” means the person using Waxwing.

2. This agreement

By downloading, installing or using Waxwing, or by buying a plan, you agree to these terms. If you don't agree, please don't use Waxwing. You must be at least 16 years old to use it. If you use Waxwing for an organisation, you confirm that you may accept these terms on its behalf.

Some parts of these terms apply only to consumers: people who use Waxwing mainly for purposes outside their trade, business or profession. Under Polish law, a sole trader who buys Waxwing for a purpose that isn't professional for them, as shown in their business registration, has the same protections as a consumer under these terms. Nothing in these terms takes away rights that consumer law gives you.

3. What Waxwing is and what it needs

Waxwing is a mail app for the Mac. It connects directly from your Mac to Gmail and to other mail providers over IMAP and SMTP. It lets you read, write, search and organise mail, and it offers optional AI features and a built-in MCP server that AI apps on your Mac can use. The website waxwing.email offers information about Waxwing, downloads, the Windows waitlist, checkout, sign-in and your account page.

To use Waxwing you need:

4. Your licence

Waxwing is licensed to you, not sold. We give you a personal, non-exclusive, non-transferable licence to install and use Waxwing on Macs you own or control, within what your plan includes:

You may not copy Waxwing for others, sell, rent or sublicense it, share a paid licence beyond your plan, or remove or get around its licence checks. You may not reverse engineer it, except where the law allows you to. We keep all rights to Waxwing, its name and its logo. Open-source parts of Waxwing are covered by their own licences, which come with the app, and nothing in these terms limits your rights under those licences.

5. Your Waxwing account

A Waxwing account is for one person. Keep your sign-in safe, and don't share it. You're responsible for the Macs you sign in on with your account. You can sign a Mac out, or delete your account, at any time at waxwing.email/account.

If you break the rules under Acceptable use, we may suspend your account, in the way that section describes. Deleting your account signs every Mac out of it, and leaves your mail and your data on those Macs untouched.

6. The beta

Waxwing is in beta. During the beta, features may change, appear or go, and Waxwing may have bugs. The beta is free. We'll email you at least 30 days before the beta ends or before an account feature becomes paid, and nothing you set up on your Mac is deleted when that happens.

7. Your mail and your data

Your mail, contacts, files and settings are yours, and we claim no rights to them. Waxwing doesn't send them to us: they stay on your Mac and with your mail provider, except where you choose to send something to an AI service (see AI features) or let an AI app use your mailbox (see Connecting AI apps).

Three other things can reach us, and none of them includes your mail: a problem report, which is sent only when you press Send; anonymous setup counts, which you can turn off; and your Waxwing account, if you create one, which is your email address, held by Clerk, and the Macs you sign in on. All three are described in the Privacy Policy.

You are responsible for having the right to use the mail accounts you add, and for following your mail providers' terms. Your mail provider keeps the main copy of your mail. Waxwing keeps local backups, but please keep your own backups of anything important.

8. Plans and payment

Paid plans aren't on sale during the beta. This section applies once they are.

9. Cancelling and refunds

Cancel any time by writing to support@waxwing.email or by using the billing link in your receipt email. Your plan stays active until the end of the period you've paid for, and then Waxwing goes back to the free version.

14-day refund. If you ask within 14 days of your first payment for a plan, or within 14 days of a yearly renewal, we'll refund that payment in full, with no questions asked. Monthly renewals after the first payment aren't refunded, but you can cancel before the next one. Refunds go back to the payment method you used, within 14 days of your request. After a refund, the plan ends and Waxwing goes back to the free version.

Your legal right to withdraw. If you're a consumer, the law gives you 14 days to withdraw from a contract made online. Our 14-day refund covers that right and goes further: you can use it whether or not the law's right still applies to you, for example after you've started using a paid plan. To use either, send us a clear message, such as: “I withdraw from my Waxwing [plan] purchase made on [date] with the email [address].”

10. When a plan ends

When a paid plan ends, for any reason, Waxwing keeps working as the free version. Your accounts, mail, search and settings stay where they are, and you can keep reading, writing and searching your mail. Only the features of the paid plan stop. Waxwing never locks you out of your mail because a payment stopped.

11. AI features

AI features are optional and stay off until you turn them on. Depending on what you choose, they work in one of three ways:

AI can be wrong. Summaries can leave things out. Commitments, invoices, amounts and dates can be missed or misread. Translations and drafts can be inaccurate. Please check anything important before you rely on it, and especially before you send, pay or file something. Waxwing never sends a message written by AI unless you press Send, or approve the request of an AI app.

Agents and exports, like the export for your accountant, help you organise documents. They aren't accounting, tax or legal advice.

12. Connecting AI apps

Waxwing's MCP server lets AI apps you choose, such as Claude or Claude Code, work with your mailbox. You decide which apps connect and what each one may do, and Waxwing logs what they do and asks for your approval before anything is sent. Those apps are made by other companies and are covered by their own terms. AI apps can be misled by instructions hidden in the mail they read, so please check each request before you approve it. Actions you approve count as your own.

13. Acceptable use

You agree not to use Waxwing or waxwing.email to:

If you seriously or repeatedly break these rules, we may suspend your Waxwing account, your paid licence or your access to hosted AI. We'll tell you why first and give you a chance to respond, unless the situation is urgent, for example if fraud or harm to others is involved.

14. Updates and changes to Waxwing

Waxwing checks for updates and can install them automatically. You can turn this off in Settings. Updates are signed, and Apple notarizes every release.

We improve Waxwing over time, so features may be added, changed or removed. If a change makes your paid plan noticeably worse for you, we'll tell you in advance. You can then cancel and get a refund for the part of your period you haven't used.

15. Other companies' services

Waxwing works with services that other companies run: your mail providers, Apple, Anthropic, Stripe and any reseller we sell through, Clerk for sign-in, and Amplitude for website analytics. Their own terms apply to them. We aren't responsible for their availability or for changes they make, for example if a mail provider changes how apps may sign in.

16. Our responsibility

If you're a consumer, the law requires Waxwing to match its description and to work as stated in these terms, and these terms don't limit those rights. If it doesn't work as it should, tell us and we'll fix it. If we can't fix it within a reasonable time, you can ask for a lower price or end the contract and get your money back.

If you use Waxwing for business, it is provided “as is”, as far as the law allows. We don't promise that it will run without interruptions or errors, or that it will suit a particular purpose. Our total liability to you is limited to what you paid us in the 12 months before the claim, and we aren't liable for indirect losses, lost profits or lost data.

Nothing in these terms limits our liability for harm caused intentionally or through gross negligence, for death or personal injury, or for anything else that the law doesn't allow us to limit.

17. Complaints

If something isn't right, write to support@waxwing.email. Tell us what went wrong, what you'd like us to do, and the email address you bought with, if your complaint is about a purchase. We'll reply within 14 days. If you're a consumer and we don't reply within 14 days, your complaint counts as accepted.

If we can't agree, consumers can get free help out of court. In Poland, that help comes from municipal and county consumer ombudsmen (rzecznik konsumentów) and the consumer bodies listed at prawakonsumenta.uokik.gov.pl. Consumers in other EU countries can ask their national consumer centre.

18. Ending this agreement

You can stop using Waxwing at any time by deleting it. Cancelling a subscription is covered under Cancelling and refunds.

We may end your paid licence if you seriously break these terms, after telling you why, as described under Acceptable use. If we stop selling a plan, or stop offering a paid feature before your period ends, we'll refund the part of your period you haven't used.

19. Changes to these terms

We may update these terms, for example when Waxwing gains features or the law changes. The current version is always on this page, with the date it was last updated. If a change matters for a paid plan, we'll email you at least 30 days before it takes effect. It applies from your next renewal, and you can cancel before then.

20. Law and courts

These terms are governed by Polish law. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. Disputes with business customers go to the court that has jurisdiction over our registered address in Warsaw.
